MICHELLE E. SCARLETT, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Alina I. Marshall Judge

This case is calendared for an in-person trial at the session of the Court scheduled to commence on February 13, 2023, for cases in which Baltimore, Maryland, is the place of trial.

On December 23, 2022, petitioner filed a motion to proceed remotely.

On December 23, 2022, petitioner filed a motion to dismiss for lack of prosecution. On the same day, petitioner filed a brief in support of motion to dismiss for lack of prosecution. Upon review of petitioner's filings, it appears to the Court that the brief filed December 23, 2022, is duplicative of petitioner's motion to dismiss filed the same day. Accordingly, petitioner's brief filed December 23, 2022, shall be stricken from the record.

Upon due consideration, it is

ORDERED that, on or before January 20, 2023, respondent shall file a response to petitioner's motion to proceed remotely filed December 23, 2022. It is further

ORDERED that petitioner's brief in support of motion to dismiss for lack of prosecution filed December 23, 2022, at Docket Index No. 23 is hereby stricken from the record. It is further

ORDERED that, on or before January 20, 2023, respondent shall file a response to petitioner's motion to dismiss for lack of prosecution filed December 23, 2022.
