VICTORY, J., not on panel.

CALOGERO, C.J., would grant the relief requested allowing the relator an extension of time, 60 days after the transcripts of hearing have been completed, to file a writ application reviewing the trial court's rulings in the post conviction hearing and its ruling denying relief.

LEMMON, J., dissents and would not deny the stay at this time until this court obtains more information on why the transcriptions on the hearings on the post conviction applications have not been filed.
