MEMORANDUM OPINION


On February 2, 2009, we notified appellants David Scales and Allegheny Casualty that the fee for the clerk's record in this case had not been paid and that if appellants failed to pay the fee within ten days, the appeal would be dismissed. To date, appellants have not paid the fee or otherwise communicated with the Court regarding this appeal.

Accordingly, we DISMISS this appeal. See Tex. R. App. P. 5, 42.3(c); Appendix to the Tex. R. App. P. (B)(1)(a).
