OPINION and ORDER


Plaintiff Vito Savino ("plaintiff") filed this action on May 4, 2000. On May 24, 2000, defendants State of New York Workers' Compensation Bd. and Robert Snashall ("defendants") filed a motion to dismiss pursuant to Federal Rule of Civil Procedure 12(b)(6), alleging that the action is barred by the doctrine of res judicata. The Court adjourns the pre-trial conference that had been scheduled for July 10, 2000 and directs plaintiff to respond to defendants' motion by that date.

SO ORDERED.
