DECISION & ORDER ON MOTION

Motion by the plaintiffs-respondents for leave to file a replacement brief on an appeal from an order of the Supreme Court, Suffolk County, dated November 15, 2010. Application by the appellant Frances Nesti pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a reply brief.

Upon the papers filed in support of the motion, and the papers filed in opposition thereto, and upon the papers filed in support of the application, and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and on or before September 15, 2011, the plaintiffs-respondents shall serve and file a replacement brief; and it is further,

ORDERED that on or before September 30, 2011, the appellants Carlos I. Duran and Randal Medzoyan shall serve and file a replacement reply brief, if they be so advised; and it is further,

ORDERED that the application is denied as premature in light of the determination of the motion.
