APPEAL AND ERROR, § 66order dismissing complaint as to one of several defendants. In action for attorney's fees against three defendants, order striking count of amended complaint and dismissing cause against one of defendants was not final and appealable order, where there was left for consideration all questions raised between plaintiff and remaining two defendants, and also issues raised by counterclaim filed by one of remaining defendants against the other.

Appeal from the Circuit Court of Cook county; the Hon. HARRY M. FISHER and BENJAMIN P. EPSTEIN, Judges, presiding.

Judgment affirmed. Heard in the third division, first district, this court at the December term, 1946.
