SELVIN SANTOS-HERNANDEZ, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 292nd Judicial District Court Dallas County, Texas
Trial Court Cause No. F13-30682-V

ORDER

The Court REINSTATES the appeal.

On April 12, 2016, we ordered the trial court to make findings regarding whether court reporter Robin Washington has done any work transcribing the reporter's record and, if not, whether she should be required to surrender her notes for transcription by another court reporter. We ADOPT the trial court's findings that: (1) Ms. Washington has begun transcribing the notes; (2) she indicated she would file the reporter's record by May 9, 2016; and (3) surrender of the notes is not necessary.

We ORDER court reporter Robin Washington to file the complete reporter's record, including all exhibits admitted into evidence, by FRIDAY, MAY 13, 2016. If the complete record is not filed by that date, we will utilize the available remedies, which may include ordering that Ms. Washington surrender her notes to the trial court for transcription by another court reporter.

We DIRECT the Clerk to send copies of this order to the Honorable Brandon Birmingham, Presiding Judge, 292nd Judicial District Court; Peri Wood, official court reporter, 292nd Judicial District Court; court reporter Robin Washington; and to counsel for all parties.
