Santoro v. Marcus Trucking Company, Inc.

Appellate Division of the Supreme Court of New York, Fourth Department
Mar 2, 1949
275 App. Div. 740 (N.Y. App. Div. 1949)

Opinion

March 2, 1949.

Present — Taylor, P.J., McCurn, Vaughan, Kimball and Piper, JJ.

Judgment and order reversed on the facts and a new trial granted, with costs to the appellants to abide the event, on the ground that the finding of the jury as to defendants' negligence and plaintiffs' lack of negligence is against the weight of evidence. All concur. (The judgment is for plaintiffs in an automobile negligence action. The order denies a motion for a new trial.)
