MEMORANDUM ORDER


This is a Social Security review case filed fourteen months ago. The court entered a scheduling order of the type routinely employed in this district in such Social Security cases on August 9, 1999. Pursuant to this order plaintiff was required to file her dispositive motion and supporting brief by January 26, 2000 and defendant was required to do the same within thirty days thereafter.

To date, plaintiff has failed to file such submissions, to request any extension of time in which to do so or otherwise in any way to prosecute her case. On the other hand, defendant has never moved for judgment or sought dismissal for plaintiff's failure to comply with the court's order or to prosecute her claim.

The court cannot permit to remain active indefinitely on its docket a case simply because neither party appears interested in resolving the case efficiently.

ACCORDINGLY, this day of September, 2000, IT IS HEREBY ORDERED that the above case shall be place in suspense pending advice from the parties that they are interested in actually litigating this matter to conclusion.
