It is ordered that the opinion filed herein on October 27, 2008, be modified as follows:

1. On page 9, the citation following the final sentence of the second full paragraph stating: "(See Schroeder v. Irvine City Council (2002) 97 Cal.App.4th 174, 180-181; League of Women Voters v. Countywide Crim. Justice Coordination Com. (1988) 203 Cal.App.3d 529, 548-549.)" is deleted and the following is inserted in its place: (See Schroeder v.
