DARYL A. SANDERS Petitioner(s) v. STATE OF FLORIDA Respondent(s)

Lower Tribunal No(s).: 642019CF304639XXXADB; 642019CF302927XXXADB

Because Petitioner has failed to show a clear legal right to the relief requested, he is not entitled to mandamus relief. Accordingly, the petition for writ of mandamus is hereby denied. See Huffman v. State, 813 So.2d 10, 11 (Fla. 2000). No motion for rehearing will be entertained by this Court.

The Court hereby expressly retains jurisdiction to pursue any possible sanctions against Petitioner. See generally Fla. R. App. P. 9.410(a).

Since 2020, Petitioner has initiated seventeen other cases in this Court. To date, the Court has transferred, dismissed, or denied sixteen of Petitioner's filings. See Sanders v. State, 2022 WL 4375756 (Fla. Sept. 22, 2022) (mandamus petition transferred); Sanders v. State, 2022 WL 4087819 (Fla. Sept. 7, 2022) (prohibition petition transferred); Sanders v. State, 2022 WL 3036690 (Fla. Aug. 2, 2022) (mandamus petition dismissed); Sanders v. Dixon, 2022 WL 627446 (Fla. Mar. 4, 2022) (mandamus petition transferred); Sanders v. State, 2022 WL 18550 (Fla. Jan. 3, 2022) (mandamus petition transferred); Sanders v. Fla. Dep't of Children and Families, 2021 WL 6066818 (Fla. Dec. 22, 2021) (mandamus petition dismissed); Sanders v. Fla. Dep't of Children and Families, 2021 WL 6065739 (Fla. Dec. 22, 2021) (mandamus petition dismissed); Sanders v. Fla. Dep't of Children and Families, 2021 WL 5088222 (Fla. Nov. 2, 2021) (mandamus petition denied); Sanders v. State, 2021 WL 4901004 (Fla. Oct. 21, 2021) (mandamus petition transferred); Sanders v. Fla. Dep't of Children and Families, Case No. SC21-1355 (Fla. Sept. 30, 2021) (mandamus petition transferred); Sanders v. Fla. Dep't of Children and Families, 2021 WL 2366264 (Fla. June 9, 2021) (prohibition petition transferred); Sanders v. State, 2021 WL 942467 (Fla. Mar. 12, 2021) (mandamus petition transferred); Sanders v. State, 2021 WL 5949842 (Fla. Oct. 8, 2021) (mandamus petition transferred); Sanders v. Fla. Dep't of Children and Families, Case No. SC20-1283 (Fla. Aug. 30, 2020) (mandamus petition transferred); Sanders v. State, 2020 WL 5948942 (Fla. Oct. 8, 2020) (mandamus petition transferred); Sanders v. Chitwood, 2020 WL 3032693 (Fla. June 5, 2020) (habeas petition transferred).

This Court has chosen to sanction pro se petitioners who have abused the legal process and otherwise misused this Court's limited judicial resources by filing repeated frivolous pro se pleadings. Such petitioners have been barred from initiating further proceedings in this Court unless their pleadings, motions, or other requests for relief were filed under the signature of a member of The Florida Bar in good standing. See, e.g., Steele v. State, 14 So.3d 221 (Fla. 2009); Pettway v. McNeil, 987 So.2d 20 (Fla. 2008); Tate v. McNeil, 983 So.2d 502 (Fla. 2008).

It appearing that Petitioner has abused the judicial process by filing numerous pro se filings in this Court that are either meritless or not appropriate for this Court's review, the Court now takes action. Therefore, Daryl A. Sanders is hereby directed to show cause on or before January 24, 2023, why he should not be barred from filing any pleadings, motions, or other requests for relief in this Court, unless such filings are signed by a member of The Florida Bar in good standing.

CANADY, POLSTON, COURIEL, GROSSHANS, and FRANCIS, JJ., concur.
