JUDGMENT IN A CIVIL CASE

Decision by Court. This action came to trial or hearing before the Court. The issues have been tried or heard and a decision has been rendered.

IT IS ORDERED AND ADJUDGED that this action is dismissed pursuant to the Order on Report Recommendation dated October 19^th, 2023 of Judge David N. Hurd which ordered that Magistrate Judge Hummel's report-recommendation is accepted; and directed Plaintiff to file a second amended complaint within thirty days or this action would be dismissed without further order. Plaintiff has failed to submit a second amended complaint as directed.
