ORDER GRANTING MOTION FOR EXTENSION OF TIME TO FILE OBJECTIONS TO THE MAGISTRATE JUDGE'S FINDINGS. CONCLUSIONS AND RECOMMENDATION


Now pending before the Court is petitioner Edward R. Sanchez's request for extension of time, which the Court has construed as a motion for extension of time in which to file his objections to the magistrate judge's findings, conclusions and recommendation. After review and consideration of the motion, the Court finds that it should be granted, in part.

It is therefore ORDERED that Petitioner's September 7, 2001 motion for extension of time be, and is hereby, GRANTED, such that petitioner Sanchez shall have until October 5, 2001 to file, not merely place in the mail, written objections to the magistrate judge's proposed findings, conclusions and recommendation.

Failure to file written objections within the specified time will bar a party, except upon grounds of plain error or manifest injustice, from attacking on appeal any unobjected-to proposed factual findings and legal conclusions accepted by the district court. Douglass v. United Services Auto Ass'n, 79 F.3d 1415, 1428-29 (5th Cir. 1996) (en banc); Carter v. Collins, 918 F.2d 1198, 1203 (5th Cir. 1990)
