DECISION & ORDER ON MOTION

Motion by Samson Management, LLC, for leave to reargue an appeal from an order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated May 21, 2010, which reversed an order of the Civil Court of the City of New York, Richmond County, entered February 2, 2009, which was determined by decision and order of this Court dated February 28, 2012, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court. Separate motions by Community Housing Improvement Program and Rent Stabilization Association of New York City, Inc., for leave to file amicus curiae briefs in support of the motion by Samson Management, LLC.

Upon the papers filed in support of the motions and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motions are denied.
