STEPHEN SAMS v. LOUISIANA DEPARTMENT OF PUBLIC SAFETY AND CORRECTIONS


In Re: Stephen Sams, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 641983. BEFORE: PETTIGREW, McDONALD AND DRAKE, JJ.

WRIT GRANTED. A review of relator's writ application reflects that relator is in possession of the Brief Order signed by the district court commissioner and mailed to relator on March 1, 2016. However, according to the Office of the Clerk of Court of the 19th Judicial District Court, relator has not filed a brief in the district court. Therefore, according to the Brief Order, the commissioner is entitled to review the Louisiana Department of Public Safety and Corrections administrative record alone, for the purpose of making a recommendation to the district court pertaining to relator's Petition for Judicial Review, filed on September 2, 2015. Accordingly, the district court is instructed to proceed toward disposition of relator's petition, without undue delay.
