ORDER

This personal injury action was commenced in the Supreme Court of the State of New York, Bronx County, against Joan Conyers and Home Depot, Inc. On June 27, 2002, Home Depot U.S.A., Inc. purported to remove the action on the basis of diversity of citizenship by filing a notice of removal in this Court. Neither the complaint nor the notice of removal sufficiently alleges the citizenship either of the plaintiff or the individual defendant. See Sun Printing Publishing Ass'n v. Edwards, 194 U.S. 377 (1904). It therefore fails to establish complete diversity of citizenship.

This action is remanded to the Court from which it was removed for lack of subject matter jurisdiction.

SO ORDERED.
