Opinion issued August 24, 2005. DO NOT PUBLISH. Tex.R.App.P. 47.

On Appeal from the County Criminal Court No. 10, Dallas County, Texas, Trial Court Cause No. MA97-38221-L. Dismissed.

Before Justices MORRIS, LANG, and MAZZANT.

MEMORANDUM OPINION

In this case, Scott Allen Samford, Jr., entered a negotiated nolo contendere plea to stalking. On September 10, 1997, pursuant to the plea agreement, the trial court assessed punishment at sixty days' confinement in jail and a $300 fine. Appellant's August 2, 2005 notice of appeal is untimely as to the September 10, 1997 sentencing date, leaving us without jurisdiction over the appeal. See Tex.R.App.P. 26.2(a)(1); Slaton v. State, 981 S.W.2d 208, 210 (Tex.Crim.App. 1998) (per curiam); Olivo v. State, 918 S.W.2d 519, 523 (Tex.Crim.App. 1996); Boyd v. State, 971 S.W.2d 603, 605-06 (Tex.App.-Dallas 1998, no pet.). We dismiss the appeal for want of jurisdiction.
