DAVID SAMARIPAS, JR., Appellant v. THE STATE OF TEXAS

ON APPELLANT'S MOTION FOR REHEARING

Meyers, J., filed a statement dissenting to the denial of Appellant's Motion for Rehearing. DISSENTING STATEMENT

Although I delivered the original opinion in this case, I now agree with the dissent that the language of former Texas Penal Code Section 12.42(e) was ambiguous. Therefore, I would grant rehearing in this case to examine extratextual factors to determine the statute's meaning. Filed: March 18, 2015
