ORDER GRANTING DEFENDANT/COUNTER-CLAIMANT KURT SAUER'S EX PARTE APPLICATION FOR ORDER TO FILE ITEMIZED BILLING STATEMENTS UNDER SEAL
The Court, having considered defendant/counter-claimant Kurt Sauer's Ex Parte Application for Order To File Itemized Billing Statements Under Seal, and good cause appearing therefore, IT IS HEREBY ORDERED as follows:
1. Mr. Sauer is permitted to file his counsel's itemized billing statements under seal in paper format in connection with his Motion for Attorneys' Fees due to be filed by October 17, 2008;
2. The itemized billing statements prepared by Mr. Sauer's counsel shall remain gam under seal, unless otherwise ordered by the Court.
3. Mr Sauer shall serve a copy of the Order on Plaintiff within ten (10) days of the date of the Order.

STATE OF CALIFORNIA, COUNTY OF SACRAMENTO I am employed in the County of Sacramento, State of California. I am over the age of 18 and not a party to the within action; my business address is 11025 Trade Center Drive, Suite 150, Rancho Cordova, California 95670. On I served the foregoing document described as on the other parties in this action as stated on the attached service list. Electronic Service of Pleadings in this matter and as set forth on the attached Service List. I am readily familiar with the firm's practice of collection and processing of correspondence for mailing. Under that practice, a true copy of the above document was placed in a sealed envelope and deposited with the U.S. Postal Service on that same day with postage thereon fully prepaid at California, in the ordinary course of business. I am aware that on motion of the party served, service is presumed invalid if the postal cancellation date or the postage meter date is more than one day after the date of deposit for mailing in affidavit. I caused each document to be delivered by electronic facsimile to the offices on the attached service list.
