EDWIN CHARLES SALTER, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the Criminal District Court No. 1 Dallas County, Texas
Trial Court Cause No. F14-39502-H

ORDER

The Court REINSTATES the appeal.

On November 20, 2015, we ordered the trial court to make findings regarding whether appellant filed a motion for new trial and, if so, the date on which it was filed. On December 15, 2015, we received a letter from the Dallas County District Clerk's Office stating that appellant filed a motion to suppress not a motion for new trial. On January 7, 2016, we received a letter from the trial court stating that no motion for new trial could be located. We ADOPT this as a finding that no motion for new trial is in the record. We will dispose of appellant's November 6, 2015 motion to extend time to file his notice of appeal in due course.
