Opinion

APPEAL No. 1007.

September 29, 1970.

This matter came on to be heard in Open Court on June 30, 1970 on motion of attorney for defendant to withdraw as counsel, and plaintiff's objection to said motion. Defendant's counsel's motion to withdraw was granted and defendant was given until September 15, 1970 in which to obtain new counsel or appear on that date and show cause why appeal should not be dismissed for lack of prosecution.

Defendant having failed to do either, it is hereby ordered that the appeal in the above-entitled matter be dismissed for lack of prosecution.

David F. Sweeney. for plaintiff.

Don G. Sinesi, for defendant.
