MEMORANDUM OPINION


On March 7, 2007, the Court abated the appeal upon appellant's filing of bankruptcy. In response to our March 10, 2011 letter inquiring about the status of the bankruptcy proceedings, we received a letter from appellant's counsel stating appellant was granted a discharge in bankruptcy on January 27, 2011, which effectively concluded this matter. Thus, appellant states, no further action need be taken. We will treat this as a motion to dismiss the appeal. As such, we grant the motion and dismiss the appeal.
