DECISION & ORDER ON MOTION

Motion by the respondent for an expedited briefing schedule and a preference in the calendaring of an appeal from an order of the Supreme Court, Westchester County, entered September 17, 2012.

Upon the papers filed in support of the motion and the papers filed relation thereto, it is

ORDERED that the motion is granted, the appeal shall be perfected on or before February 5, 2013, the respondent shall serve and file a brief, if any, on or before March 12, 2013, and the appellant shall serve and file a reply brief, if any, on or before March 27, 2013; and it is further,

ORDERED that the appeal will be calendared expeditiously after all of the briefs have been filed.
