ORDER ADOPTING FINDINGS AND CONCLUSIONS OF UNITED STATES MAGISTRATE JUDGE


Pursuant to 28 U.S.C. § 636, the Court has reviewed the Petition, all the records and files herein, and the Report and Recommendation of the United States Magistrate Judge. Objections to the Report and Recommendation have been filed by respondents. Having made a de novo determination of those portions of the Report and Recommendation to which objections have been made, the Court concurs with and adopts the findings, conclusions and recommendations of the Magistrate Judge.

IT IS ORDERED that Judgment be entered granting petitioner's Petition for Writ of Habeas Corpus in part and discharging petitioner from custody and all adverse consequences of his conviction in Los Angeles Superior Court Case No. NA023127, unless petitioner is brought to retrial within sixty (60) days of the date this Judgment becomes final, plus any additional delay authorized under State law.

IT IS FURTHER ORDERED that the Clerk serve copies of this Order and the Judgment herein by United States mail on petitioner and counsel for respondents.

JUDGMENT

Pursuant to the Order Adopting Findings, Conclusions and Recommendations of United States Magistrate Judge,

IT IS ADJUDGED that petitioner's Petition for Writ of Habeas Corpus is GRANTED in part, and that petitioner shall be discharged from custody and all adverse consequences of his conviction in Los Angeles Superior Court Case No. NA023127, unless petitioner is brought to retrial within sixty (60) days of the date this Judgment becomes final, plus any additional delay authorized under State law.
