JUDGMENT

STANLEY BLUMENFELD, JR UNITED STATES DISTRICT JUDGE.

Pursuant to the Court's Order Accepting Report and Recommendation of U.S. Magistrate Judge, IT IS ADJUDGED that the Defendant's motion for summary judgment based on lack of Prison Litigation Reform Act exhaustion (Dkt. 40) is granted. The complaint and entire action is dismissed without prejudice but without leave to amend. On this basis, judgment is hereby entered in favor of Defendant and against Plaintiff.
