ORDER VACATING FINDINGS AND RECOMMENDATIONS, RECOMMENDING THAT PLAINTIFF'S APPLICATION TO PROCEED IN FORMA PAUPERIS BE DENIED (ECF No. 11)

ORDER DENYING PLAINTIFF'S APPLICATION TO PROCEED IN FORMA PAUPERIS AS MOOT (ECF No. 2)

Rafael Salas (“Plaintiff”) is a state prisoner proceeding pro se in this civil rights action filed pursuant to 42 U.S.C. § 1983.

On April 17, 2021, the Court issued findings and recommendations, recommending that “Plaintiff's application to proceed in forma pauperis be DENIED, ” and that “Plaintiff be directed to pay the $402.00 filing fee in full if he wants to proceed with this action.” (ECF No. 11, p. 2).

Instead of objecting to the findings and recommendations, Plaintiff paid the $402 filing fee. As the filing fee has been paid in full, Plaintiff's application to proceed in forma pauperis is now moot. The Court notes that it will screen Plaintiff's complaint in due course.

Accordingly, IT IS ORDERED that:

1. The findings and recommendations recommending that Plaintiff's application to proceed in forma pauperis be denied (ECF No. 11) are VACATED; and

2. Plaintiff s application to proceed in forma pauperis (ECF No. 2) is DENIED as moot.

IT IS SO ORDERED.
