AND NOW, this 6^th day of July, 2005, it appearing that:

A. On May 23, plaintiff filed a Motion for Entry Pursuant to Paragraph XVI.E of the Franchise Agreement (Doc. No. 10).

B. On June 15, 2005, the court deemed this motion a "second motion for preliminary injunction" and granted the motion (Doc. No. 25).

It is ORDERED that plaintiff's Motion for Entry Pursuant to Paragraph XVI.E of the Franchise Agreement (Doc. No. 10) shall be deemed disposed of in accordance with the court's Memorandum and Order of June 15, 2005 (Doc. No. 25).
