May 20, 2009
8 So. 3d 505 (Fla. Dist. Ct. App. 2009)

Opinion

No. 4D08-4212.

May 20, 2009.

Appeal from the State of Florida Department of Revenue, Child Support Enforcement Program; L.T. Case No. 1164130293.

Farnol Saintil, Fort Lauderdale, pro se.

Bill McCollum, Attorney General, and Toni C. Bernstein, Assistant Attorney General, Tallahassee, for appellee.

Based upon the state's concession of error that the Proposed Administrative Support Order for child support was not sent to the appellant at the correct address, we reverse the final order. We remand for the Department to hold an administrative hearing consistent with the appellant's request, which the Department concedes should be considered timely.

WARNER, POLEN and DAMOORGIAN, JJ., concur.
