By post-card notice dated March 22, 2024, we notified appellants that their brief was past due, instructed them to file their brief along with an extension motion, and cautioned them that failure to do so would result in dismissal of the appeal without further notice. All appellants except Sai Surya Investments, LLC filed extension motions. Because appellant Sai Surya Investments, LLC has failed to file a brief and the time to do so has passed, we DISMISS it as a party to this appeal. See Tex. R. App. P. 38.8(a)(1). We DIRECT the Clerk of this Court to remove appellant Sai Surya Investments, LLC from the style of this case.
Before the Court are the (1) June 20, 2024 unopposed fourth motion of appellants Satish Akasapu and Prasad Govindaraj for an extension of time to file their opening brief and (2) June 21, 2024 unopposed fourth motion of appellants Arul Chender Rajah, Chender Rajah, and World One Cuisine Texas, LLC for an extension of time to file their brief. As with their third extension motions, appellants explain in the motion that the parties have reached a final settlement agreement and are waiting on the signature of appellee's counsel who is currently out of the country. We GRANT the motions to the extent that appellants shall file either a motion to dismiss or their opening briefs on or before July 22, 2024. We caution appellants that failure to file either a motion to dismiss or their opening briefs on or before July 22, 2024 may result in dismissal of their appeal for want of prosecution without further notice. See id.
