State ex rel. Young v. Adult Parole Auth. (1970), 24 Ohio St.2d 67, 53 O.O.2d 87, 263 N.E.2d 399; Sager v. Haskins (1965), 1 Ohio St.2d 88, 30 O.O.2d 237, 204 N.E.2d 233. R.C. 2929.41, which became effective January 1, 1974, simply reverses this presumption when multiple sentences do not specify whether they are to be served concurrently or consecutively and provides in pertinent part as follows: "(A) Except as provided in division (B) of this section, a sentence of imprisonment shall be served concurrently with any other sentence of imprisonment imposed by a court of this state, another state, or of the United States. * * *
As respondent points out, concurrent sentences require a positive act of the court, and unless otherwise specified separate sentences for different crimes run consecutively. Sager v. Haskins (1965), 1 Ohio St.2d 88. In the instant case, relator's 1960 sentence was not made to run concurrently with his 1954 sentence.
"If he is sentenced to imprisonment in the penitentiary, he shall be returned thereto by the sheriff and his new term of imprisonment shall, at the direction of the court, begin at the expiration of the term for which he was in prison at the time of his removal or run concurrently with such term, except as otherwise provided in Section 2901.11 of the Revised Code." These statutes relate only to the actual running of sentences and have no relation to eligibility for consideration for parole, which is now determined, in the circumstances of this case, by the applicable provisions of Sections 2967.25 and 2967.13, Revised Code. Compare repealed Sections 2965.35 and 2965.23, Revised Code, and Sager v. Haskins, Supt., 1 Ohio St.2d 88. Section 2967.25 now provides in pertinent parts: "A person serving several indeterminate sentences consecutively shall become eligible for parole upon the expiration of the aggregate of the minimum terms of his several sentences * * *. Where the aggregate of the minimum terms is longer than fifteen years, eligibility for parole shall be determined in accordance with Section 2967.13 of the Revised Code. For the purpose of this section, a person is serving consecutive sentences whenever any of the following occur:
