ORDER AMENDING MEMORANDUM DISPOSITION AND DENYING THE PETITIONS FOR PANEL REHEARING AND APPELLANTS' JOINT PETITION FOR REHEARING EN BANC, D.C. No. CV-00-00621-JLR.

Before: ALARCÓN, RYMER, and BERZON, Circuit Judges.


The memorandum disposition filed March 30, 2007 is amended by adding a footnote at the end of the last line of Section X at the bottom of page 29 after the words "deprived the Safouanes of their constitutional rights" as follows:

This court cannot affirm the district court's dismissal of the Safouanes' claims regarding the foster parents on the statute of limitations ground on this record. The parties are free to pursue this issue on remand.

With the opinion as amended, the panel has voted to deny Appellants' joint petition for panel rehearing, and Appellees' joint petition for panel rehearing.

Judge Rymer and Judge Berzon have voted to deny Appellants' joint petition for rehearing en banc. Judge Alarón recommends that Appellants' joint petition for rehearing en banc be denied.

The full court has been advised of the petition for rehearing en banc and no active judge has requested a vote on whether to rehear the matter en banc. Fed.R.App.P. 35.

The petitions for rehearing and the petition for rehearing en banc are DENIED. No further petitions for rehearing will be entertained.

The mandate shall issue forthwith.
