SAFETY HOLDINGS, INC. D/B/A SAMBASAFETY, Appellant v. D'QUESHA WILSON, Appellee
On Appeal from the 11th District Court Harris County, Texas Trial Court Cause No. 2021-32920
Panel Consists of Justices Hassan, Poissant, and Wilson.
ABATEMENT ORDER
PER CURIAM
On April 10, 2024, the parties filed a joint motion to abate this appeal to allow them to finalize their agreements to resolve all claims and causes of action between them. We grant the motion and issue the following order.
The motion is ambiguous about whether the parties are also seeking to permit proceedings in the trial court to effectuate their agreements pursuant to Texas Rule of Appellate Procedure 42.1(a)(2)(C). However, that rule requires the parties to provide "an agreement signed by the parties or their attorneys and filed with the clerk" of this court. See Tex. R. App. P. 42.1(a)(2). As the motion is not accompanied by any signed agreement, we construe the motion as solely seeking an abatement to allow the parties to finalize their agreements.
The appeal is abated, treated as a closed case, and removed from this court's active docket until June 17, 2024. The appeal will be reinstated on this court's active docket at that time, or when the parties file a motion to dismiss the appeal or other dispositive motion. The court will also consider an appropriate motion to reinstate the appeal filed by any party, or the court may reinstate the appeal on its own motion.
