Saenz v. State

District Court of Appeal of Florida, Second District
Jun 30, 2000
761 So. 2d 1226 (Fla. Dist. Ct. App. 2000)

Opinion

No. 2D99-3050.

June 30, 2000.

Appeal from the Circuit Court for Sarasota County; Robert W. McDonald, Jr., Judge.

James Marion Moorman, Public Defender, and Brad Permar, Assistant Public Defender, Bartow, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Eroca M. Raffel, Assistant Attorney General, Tampa, for Appellee.

Jose Saenz appeals either the revocation of his community control or probation, or both. We affirm the revocation but remand for the entry of written order of revocation, in conformance with the oral pronouncement, listing the specific condition of community control and/or probation which Saenz violated. See Donley v. State, 557 So.2d 943 (Fla.2d DCA 1990).

Affirmed and remanded with instructions.

CAMPBELL, A.C.J., and PARKER and SALCINES, JJ., Concur.
