MEMORANDUM ORDER


Fourth-Party Defendant UCF America Inc. ("UCF") moves, pursuant to Rule 56 of the Federal Rules of Civil Procedure, for an order granting it summary judgment dismissing the Fourth-Party Complaint interposed by Fourth-Party Plaintiff Triangle Spring Works, Inc. ("Triangle Spring Works") and seeking dismissal of all cross-claims against UCF.

The Court has reviewed thoroughly the papers in support of and in opposition to the motion of Triangle Spring Works. It appears that there is a genuine disputed issue of material fact as to whether UCF manufactured the spring in question. Accordingly, the motion for summary judgment is DENIED.

SO ORDERED.
