Sadler v. State

District Court of Appeal of Florida, First District
Apr 13, 2004
870 So. 2d 902 (Fla. Dist. Ct. App. 2004)

Opinion

Case No. 1D04-0195.

April 13, 2004.

An appeal from the Circuit Court for Duval County, Lance M. Day, Judge.

Appellant, pro se.

Charlie Crist, Attorney General, Tallahassee, for Appellee.

We affirm the trial court's summary denial of the appellant's postconviction motion but remand to the trial court to correct a scrivener's error, which erroneously lists the appellant's second-degree murder conviction as a second-degree felony instead of a first-degree felony punishable by life. See Netterville v. State, 673 So.2d 986 (Fla. 1st DCA 1996).

Affirmed.

BOOTH, POLSTON, and HAWKES, JJ., concur.
