ORDER OF DISMISSAL

LAUREN J. KING, United States District Judge

The Court has conducted a de novo review of the Report and Recommendation of the assigned United States Magistrate Judge, any objections or responses to that, and the remaining record.

Based upon the Court's review, the Court finds and ORDERS as follows:

(1) The Court ADOPTS the Report and Recommendation that the case be dismissed because Plaintiff has filed suit against Defendants who are immune from the alleged violations; the complaint challenges an on-going state criminal prosecution; and Plaintiff has failed to pay the filing fee or submit an application to proceed in forma pauperis despite being advised that the failure to do so would result in dismissal of this matter.

(2) The case is accordingly DISMISSED with prejudice.

(3) The Clerk is directed to send copies of this Order to the parties.
