Appeal from Superior Court, Sacramento County; P.J. Shields, Judge.

Action by the Sacramento Paving Company against Robert Martyr and others. From an order denying a motion for a new trial, defendants appeal. Affirmed.

OPINION

BUCKLES, J.

This is an appeal from an order denying defendants’ motion for a new trial in an action to recover for street assessment for improving Eighteenth street in the city of Sacramento. The questions involved are exactly the same as in Sacramento Paving Company (a corporation), Plaintiff and Respondent, v. James Anderson, Appellant, and H.J. Goethe and M.I. Enos, Defendants (No. 50, this day decided by this court) 82 P. 1069.

The judgment in this case is affirmed, upon the authority in that case.
