Opinion

01-13-1905

SABIN v. SABIN.

Robert H. Ingersoll, for complainant.

Suit by Cora H. Sabin against Wallace E, Sabin. Decree denied.

Robert H. Ingersoll, for complainant.

MAGIE, Ch. The proof relied on by the master to support his report in favor of the decree of divorce is insufficient to justify the report or a decree thereon. There is no sufficientcorroboration of complainant's evidence, either in regard to a residence in this state sufficient to give jurisdiction, or in regard to the willful desertion of complainant by the defendant.

The decree sought must be denied, and no ground has been presented for opening the report for additional evidence.
