SOUTH TEXAS COLLEGE, Appellant, v. ROLANDO VILLAGRAN, Appellee.
ON APPEAL FROM THE COUNTY COURT AT LAW NO. 4 OF HIDALGO COUNTY, TEXAS
Before Chief Justice Contreras and Justices Benavides and Silva
ORDER TO FILE APPELLEE'S BRIEF
PER CURIAM
This cause is before the Court on appellee's failure to file appellee's brief. Appellee's brief was originally due on June 17, 2024. After two previous extensions, appellee's brief was due to be filed on or before September 13, 2024. Appellee was notified by the Clerk of the Court that no further extensions would be granted absent new and exigent circumstances. Appellee is requesting an additional thirty days to file the brief.
The Court looks with disfavor upon appellee's counsel's failure to timely file the brief. However, the Court, having fully examined and considered appellee's third unopposed motion for extension of time to file the brief and the extensions previously granted in this case, is of the opinion that, in the interest of justice, appellee's third unopposed motion for extension of time to file the brief should be granted with an order.
Accordingly, appellee's third unopposed motion for extension of time to file the brief is hereby GRANTED. IT IS THEREFORE ORDERED that the Honorable Ricardo R. Godinez, counsel for appellee, file an appellee brief with this Court on or before October 15, 2024. No further extensions shall be granted absent new and exigent circumstances.
