Opinion

Case No. SC10-849.

January 26, 2011.

Lower Tribunal No(s). 5D09-4330, 09-CA-180.

Upon consideration of Respondents' Motion to Lift Stay and Deny Petitioner's Brief on Jurisdiction as Moot, and response thereto, it is ordered that said motion is granted and the stay of proceedings issued by this Court on May 12, 2010, is hereby lifted.

The Court has determined that it should decline to exercise jurisdiction in this case. See Strax Rejuvenation and Aesthetics Institute, Inc. v. Shield, 35 Fla. L. Weekly S523 (Fla. Sept. 30, 2010). The petition for discretionary review is, therefore, denied.

No motion for rehearing will be entertained by the Court. See Fla.R.App.P. 9.330(d)(2).

CANADY, C.J., and PARIENTE, LEIWS, LABARGA, and PERRY, JJ., concur.
