Present — Carswell, Acting P.J., Adel, Sneed, Wenzel and MacCrate, JJ.


In an action by a landlord for a declaratory judgment, defendant tenant appeals from the judgment which declares that the lease between the parties had been terminated and that the tenant thereupon became a statutory tenant by reason of a notice sent by the landlord upon default in payment of rent, in accordance with the provisions of the lease. Judgment unanimously affirmed, with costs. No opinion.
