Russell v. State

Supreme Court of Florida
Jul 2, 2024
No. SC2024-0775 (Fla. Jul. 2, 2024)

Opinion

SC2024-0775

07-02-2024

Charles B. Russell, Petitioner(s) v. State of Florida, Respondent(s)

Lower Tribunal No(s).: 4D2007-2086; 062006CF008049A88810 062005CF013112A88810; 062006CF013613A88810; 062005CF011259A88810

To the extent Petitioner challenges the dismissal of his appeal for failure to pay the filing fee, the petition for writ of mandamus is hereby denied because Petitioner raises the same issue as in Russell v. State, 2023 WL 3360866 (No. SC2023-0248) (Fla. May 11, 2023), in which the petition was denied. Cf. Topps v. State, 865 So.2d 1253 (Fla. 2004). To the extent Petitioner challenges the order denying his motion for reinstatement, the petition for writ of mandamus is dismissed pursuant to Mathews v. Crews, 132 So.3d 776 (Fla. 2014). No motion for rehearing will be entertained.

LABARGA, COURIEL, GROSSHANS, FRANCIS, and SASSO, JJ., concur.
