Russ v. Bank of N.Y.

Supreme Court of Florida.
Sep 8, 2014
151 So. 3d 1227 (Fla. 2014)

Opinion

No. SC14–1060.

09-08-2014

Larry RUSS, et al., Petitioner(s), v. The BANK OF NEW YORK, Etc., et al., Respondent(s).

Opinion

Because petitioners have failed to show a clear legal right to the reinstatement of case number 1D14–339, to the extent that such relief is requested, the petition for writ of mandamus is hereby denied. See Huffman v. State, 813 So.2d 10, 11 (Fla.2000). To the extent the petition seeks other relief, the petition is hereby dismissed. See Mathews v. Crews, 132 So.3d 776 (Fla.2014).

Respondent's “Corrected Motion for the Clerk of Court to Administratively Dismiss Petition or for the Court to Dismiss the Petition for lack of Jurisdiction, or in the Alternative to Administratively Transfer the Case,” filed on June 16, 2014, is hereby denied.

PARIENTE, LEWIS, QUINCE, CANADY, and POLSTON, JJ., concur.
