On order of the Court, the application for leave to appeal the August 28, 2003 judgment of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court. The motion to dismiss and for costs and fees under MCR 7.316(D) is also considered, and it is DENIED.


The denial of the motion under MCR 7.316(D) does not prevent plaintiffs from seeking, in the circuit court, under paragraph 24 of the building and use restriction, costs and fees related to the appellate proceedings.
