Deon Latroy Rush v. The State of Texas

Trial court: 12th District Court of Grimes County, Trial court case number: 19016

ORDER

Richard Hightower, Judge

Appellant's brief was due on March 1, 2023. No brief was filed despite notice issued on March 16, 2023. The Court issued an order on March 30, 2023, abating the appeal and remanding to the trial court for a hearing to determine why no appellant's brief had been filed.

On March 30, 2023, appellant's counsel filed a motion asking for an extension until April 14, 2023. And later on the same day, appellant's counsel filed the brief.

The order of March 30, 2023 abating the appeal is withdrawn and the appeal is reinstated on the active docket.

Because the brief was filed as of March 30, 2023, appellant's motion for extension is dismissed as moot.

It is so ORDERED.
