DECISION AND ORDER ON MOTION

Motion for stay/preliminary injunction pending appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, without costs, to the extent that, pending determination of the appeal, all proceedings to enforce the order of Supreme Court dated July 16, 2014 are stayed, defendant Town of Mamakating is enjoined from exercising municipal jurisdiction over the Village of Chestnut Ridge project site and all other properties that are the subject of said order of Supreme Court, and defendant Village of Bloomingburg is enjoined from denying or refusing to consider applications for the issuance of building permits or certificates of occupancy based upon said order of Supreme Court. Such relief is granted without prejudice to a motion to vacate the relief in the event the appeal is not perfected on or before October 6, 2014.
