ORDER

On December 30, 2016, this court issued a memorandum opinion affirming the trial court's judgment in favor of appellee. On February 9, 2017, this court overruled appellant's motions for rehearing and rehearing en banc. Thereafter, appellant requested several extensions of time in which to file a petition for review with the Texas Supreme Court. On May 17, 2017, appellant filed a notice of advisory with the Texas Supreme Court, advising that he would not proceed further and a petition for review would not be filed with the Texas Supreme Court. On May 30, 2017, appellee filed an unopposed motion to expedite mandate pursuant to Rule 18.1(c) requesting that the mandate be issued immediately. See TEX. R. APP. P. 18.1(c). The motion is GRANTED. The clerk of the court is instructed to issue the mandate contemporaneously with this order. See id.
