It is ordered that the opinion filed herein on December 19, 2005, be modified as follows:

On page 22, in the paragraph that continues from page 21, in the third sentence that begins “If the trial court permits,� insert the phrase “with respect to� between the words “strike� and “that.�

This modification does not affect a change in the judgment.
