Opinion

CIVIL ACTION NO. 1:01-CV-217-C

April 5, 2002

ORDER

Petitioner, Leopoldo Ruiz-Ruiz, filed a petition for writ of habeas corpus pursuant to 28 U.S.C. § 2241 seeking a transfer to a federal correctional facility. At the time he filed his petition, Petitioner was incarcerated in the Big Spring Correctional Center, an institution which generally houses inmates with I.N.S. detainers lodged against them. Petitioner asserts that he is a United States Citizen and not an illegal alien.

Respondent filed a response and motion to dismiss and Petitioner filed a traverse. Respondent filed a supplemental response on March 15, 2002, advising the Court that Petitioner was transferred to F.C.I. La Tuna on February 22, 2002. Respondent requests that Petitioner's case be dismissed as moot because Petitioner has received the relief requested, no detainer has been placed on Petitioner by the I.N.S., and Petitioner has been transferred to a different facility. Petitioner has not responded to the supplemental response.

The Court finds that Petitioner has received the relief requested and that this case should be dismissed as moot.

SO ORDERED.

Any pending motions are denied.
