Ruff, and of his counsel, Mr. Ames Peterson, for dismissal of the appeal herein, and good cause therefor appearing, it is ordered that the motion be and hereby is granted, that the appeal in this cause of Fred W. Ruff be dismissed, that a judgment be filed and entered accordingly and that the mandate of this court in this cause issue forthwith.
